OSD365 Limited, a company incorporated under the laws of New Zealand and located in Auckland, New Zealand, owns this software and issues term-based licenses via subscriptions. Intellectual property laws and treaties around the world protect the software. All such rights are reserved. You may not remove, alter, or obscure any copyright, trademark, service mark, or other proprietary rights notices incorporated in or accompanying the software.
Subject to your compliance with these terms, we grant the subscriber a non-exclusive, non-transferable, time-bound, revocable license to use our software. This license is for the sole purpose of enabling you to use and enjoy the benefit of our services provided by OSD365 Limited in the manner permitted by these terms. You may not lease, lend, sell, redistribute, or sublicense the licensed application.
The subscriber, or any other party, is strictly prohibited from copying, modifying, distributing, reverse-engineering, selling, or transferring any part of our software or the issued license without our prior written consent. Sharing the license with any other party is strictly prohibited. Each subscription is valid for one person only. Any unauthorized use of our services will terminate the license granted to you.
Our subscription-based software, WPSecure Personalization Packager, enables users to create custom personalization packages for deploying desktop backgrounds, Microsoft Outlook signatures, and screensavers. Access to this software is granted to those with a legal subscription. If you do not have a subscription, you can purchase one from our website or authorized resellers.
The subscription term for the User shall be as specified in the purchase document provided either through our website or via email. The subscription will automatically renew at the end of each term unless you cancel it before the end of the current term.
Payment and Support
Please note that all fees are non-refundable. We encourage all parties to try our demo software before making a purchase. Active subscribers can optionally purchase prepaid support hours separately for installation and training support.
If the product does not function as advertised within the specified prerequisite matrix without other environment-specific influences or platform configuration conflicts, our product support team will directly deal with this without a separately purchased support package.
We reserve the right to terminate the subscriber’s license to use our software if the subscriber violates these terms and conditions or if required by law enforcement. Upon termination of these terms or your access to our services for any reason or no reason, you will continue to be bound by these terms.
Our software is provided “as is” without warranty of any kind, express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose. We do not warrant that the functions contained in our services will meet your requirements or that their operation will be uninterrupted or error-free.
Limitation of Liability
To the extent permitted by law, we shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages arising out of or in connection with your access to or use of our services.
These terms and conditions shall be governed by and construed in accordance with the laws of New Zealand. You agree that any legal action or proceedings arising out of these terms or in connection with this agreement shall be brought exclusively in New Zealand courts.
